These Terms of Service ("Terms") form a binding agreement between you and TrademarksHub regarding your use of our website and services (collectively, "the Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.
TrademarksHub is an online marketplace and professional network that connects brand owners with independent trademark professionals (attorneys, agents, paralegals, freelancers, and IP firms).
Professionals listed on TrademarksHub are independent third parties. They have their own client engagement agreements, fee arrangements, professional ethics rules, and malpractice insurance. Their work is their own — not ours.
You must be at least 16 years old to create an account. If you create an account on behalf of a company, you represent that you have authority to bind that company to these Terms.
You can register as a brand owner, professional, freelancer, or law firm. The features available to you depend on your account type. Misrepresenting your account type (e.g., posing as a verified attorney without being one) is grounds for immediate suspension.
You're responsible for keeping your password confidential and for all activity under your account. Notify us immediately at support@trademarkshub.com if you suspect unauthorized access.
If you register as a professional, freelancer, or firm, you may submit verification information (business website, business email). Verification is at our discretion. We may revoke verification if circumstances change or if false information was provided.
You retain ownership of everything you post on TrademarksHub — your profile content, trademark requests, quotes, comments, questions, photos, and so on ("User Content").
By posting User Content, you grant TrademarksHub a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and distribute your content for the purpose of operating, promoting, and improving the Service. This license ends when you delete the content, except for backup copies retained for legal compliance and copies that have been downloaded or quoted by other users.

When you engage a professional through TrademarksHub, the resulting client-professional relationship is between you and that professional only. TrademarksHub is not a party to that engagement and has no control over the work performed.
Quotes posted through TrademarksHub are non-binding estimates from the professional. The actual fees, scope, and terms of your engagement are determined by the engagement letter or agreement you sign with the professional directly.
"Verified" status on TrademarksHub means we've confirmed the basic identity markers we require (business website, business email). It does not mean we have validated bar admission, malpractice insurance, jurisdictional licensing, or fitness to practice. Always verify a professional's credentials with the relevant bar or trademark authority before forming an engagement.
If you have a dispute about work performed by a professional, that dispute is between you and the professional. You should: first, contact the professional directly; second, contact the relevant bar or licensing authority if necessary; third, pursue private legal remedies. We will assist with platform-related issues (e.g., refunding any platform fees) but cannot adjudicate professional service disputes.
Core marketplace use — posting requests, browsing pros, exchanging quotes, messaging, posting professional updates — is free.
Some features (priority placement, premium directory listing, etc.) may require credits, which can be purchased through the platform. Credits are non-refundable except where required by law. Credits do not expire unless we provide 90 days' notice.
Unless explicitly stated otherwise, professionals invoice clients directly outside the platform. TrademarksHub is not the merchant of record for professional services.
For platform credit purchases: we honor refunds within 14 days of purchase if the credits have not been used. For professional services: refunds are between you and the professional.
You are responsible for taxes applicable to your use of the Service in your jurisdiction.
The Service, including the website design, logos, code, AI-generated content, structured data, and the directory database, is owned by TrademarksHub or our licensors. You may not copy, modify, redistribute, or create derivative works of the Service without permission, except as expressly allowed (e.g., embedding a public profile via supported share buttons).
TrademarksHub integrates with third-party services including Stripe and PayPal (payments), Google (sign-in), Cloudflare (CDN), USPTO/EUIPO/WIPO (trademark search APIs), and OpenAI (AI-generated content for landing pages). Your use of those services is governed by their own terms. We're not responsible for third-party services we don't control.
You can close your account at any time via Account Settings or by emailing support@trademarkshub.com.
We may suspend or terminate your account if: you violate these Terms; you engage in fraud, abuse, or harassment; we're required to by law; or your account remains inactive for 24+ months. Where possible, we'll give you notice before suspension and a chance to cure the issue.
On termination, your access to the Service ends. Sections 4, 8, 11, 12, 13, and 14 survive termination.
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including any warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted or error-free.
We do not warrant the accuracy, completeness, or quality of any User Content, professional listing, search result, AI-generated SEO content, brand strength analysis, or any other information on the Service. Trademark search results from public databases (USPTO, EUIPO, WIPO) are not a substitute for a comprehensive clearance search by a qualified professional.
To the fullest extent permitted by law, TrademarksHub and its officers, employees, and agents will not be liable for: indirect, incidental, special, consequential, or punitive damages; lost profits, data, or business opportunities; damages resulting from professional services performed by third parties; or damages exceeding the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD 100.
This limitation applies regardless of the legal theory and even if we knew or should have known of the possibility of damages.
You agree to defend, indemnify, and hold harmless TrademarksHub from any claims, damages, or expenses (including reasonable legal fees) arising from: your User Content; your violation of these Terms; your violation of any law or third-party rights; or your engagement with professionals through the Service.
These Terms are governed by the laws of the jurisdiction where TrademarksHub is incorporated, without regard to conflict-of-laws principles. Any dispute will be resolved in the courts of that jurisdiction, except where local consumer protection law gives you stronger rights in your home jurisdiction.
Before filing a formal dispute, please email us at legal@trademarkshub.com — most issues can be resolved informally and quickly.
We may update these Terms as the platform evolves or as the law requires. Material changes will be announced via in-app notification and email at least 14 days before they take effect. Continued use of the Service after the effective date means you accept the updated Terms.
